Budget Law 2025
We would like to point out that Law no. 207 of 12/30/2024 (so-called Budget Law for the financial year 2025), in art. 1, paragraph 860, has also extended “to the directors of companies established in corporate form” the obligation to have their own certified email address, different and additional to that of the company already appearing in the Company Register of the Chamber of Commerce. This certified email address must be activated and communicated to the Company Register by 30 June 2025.
In essence, all persons who hold directorships in partnerships and corporations are required to have a personal PEC. In this regard, we remind you that - unless otherwise agreed - for S.N.C. all partners are to be considered directors, while in S.A.S. all general partners are directors. In the event that a person takes on the role of director for multiple companies, he may choose whether to use and communicate the same personal PEC address for all the companies of which he is director or, alternatively, obtain a different address for each company managed.
